Sending a service request through the website, by email, telephone or any other means of communication constitutes neither a binding order nor, by itself, the conclusion of a contract.
It enables CampArca to assess the customer’s request and, where necessary, conduct a preliminary discussion, technical study, diagnosis, measurement or physical inspection before preparing a quote or contractual proposal.
The contract is formed when the customer clearly and unequivocally accepts a quote, order form or other contractual document proposed by CampArca.
Where the customer is a consumer and the contract is concluded at a distance or off-premises, the consumer has, unless a statutory exception applies, fourteen days to exercise their right of withdrawal without giving reasons.
For service contracts, this period begins when the contract is concluded.
For contracts for the sale of goods, the period begins under the arrangements provided in the French Consumer Code, in particular upon receipt of the goods by the consumer or a third party designated by the consumer other than the carrier.
Where the contract is concluded off-premises, CampArca may not, as a general rule, receive any payment or consideration from the consumer before seven days have elapsed from conclusion of the contract, except in situations expressly provided for by regulations.
This rule on receiving payment is separate from the fourteen-day withdrawal period.
Where the consumer wishes a service to begin before the fourteen-day withdrawal period expires and the contract entails an obligation to pay, CampArca obtains the consumer’s express request in accordance with applicable provisions.
For a distance contract, this express request may be obtained by any means allowing evidence of it to be retained.
For an off-premises contract, this express request is obtained on paper or another durable medium.
The consumer also acknowledges that, once the service has been fully performed in accordance with their express request before the withdrawal period expires, they will no longer have the right of withdrawal under the conditions provided by regulations.
If the consumer exercises their right of withdrawal after a service has begun at their express request before the fourteen-day period expires, they remain liable for the amount corresponding to the service actually provided until they communicate their decision to withdraw, under the conditions laid down by the French Consumer Code.
This amount is proportionate to the total agreed price of the service.
No amount may be claimed from the consumer for performance begun before the withdrawal period expires where the formalities required by regulations for that early performance have not been observed.
The right of withdrawal does not apply, in particular, to urgent maintenance or repairs at the consumer’s home expressly requested by the consumer, limited to replacement parts and work strictly necessary to address the emergency.
Other exceptions to the right of withdrawal provided by the French Consumer Code may also apply depending on the nature of the goods, equipment ordered or service concerned.
Where the right of withdrawal applies, the consumer may exercise it under the conditions laid down by the French Consumer Code and using the withdrawal form made available by CampArca.
